Acceptance of Terms
By accessing this website, purchasing via Amazon, other eCommerce platforms, or placing orders by phone, you agree to be bound by these Terms and Conditions. Please read carefully before purchasing. If you do not agree, refrain from using the site or placing an order. All materials on this website are protected by copyright and trademark law.

Use License
USSC grants you a temporary, non-exclusive license to download one copy of materials on our website for personal, non-commercial, transitory viewing only. Restrictions: no modification, copying, commercial use, reverse engineering, or removing copyright/proprietary notices.

Disclaimer
All materials and products are provided ‘as is.’ USSC disclaims all other warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitations of Liability
USSC will not be liable for damages from use or inability to use products, including loss of profits, data, or business interruption.

Online Store and Phone Orders

(a) Our Contract: Order acknowledgment is not acceptance. Contract forms only when goods ship.

(b) Pricing & Availability: Subject to error. USSC will notify you of errors.

(c) Payment: Cards authorized at order placement; funds treated as deposit until shipment.

(d) Payment Terms / Invoiced Orders: Due within 30 days. Past due accounts may be sent to collections after 60 days. 3% monthly service charge. Customer pays collection/legal fees. Disputes must be raised in writing within 15 days.

(e) Severability: Invalid provisions do not affect enforceability of remaining terms.

Warranty & Return Policy

Warranty
USSC warrants its paint products to be free from manufacturing defects and to conform to specifications. Defective products will be replaced or refunded. Limited to original purchaser, non-transferable, excludes labor, misuse, improper storage, and conditions beyond USSC’s control.

General Returns
Must be requested within 30 days of delivery.

  • Require prior authorization.
  • Must be unopened/unused.
  • 25% restocking fee applies.
  • Refunds to original payment method.
  • Amazon purchases may be subject to Amazon’s return policy.

Aerosol Returns

All aerosol paints are classified as hazardous materials and must be shipped by ground only. If a customer chooses to return aerosol products for reasons other than damage, defect, or USSC error (e.g., ordered by mistake or no longer needed), the customer is responsible for arranging and paying for ground return shipping. Aerosol products cannot be returned via air shipment (FedEx Express, UPS Next Day, etc.) due to federal regulations.

Freight Orders & Returns

Large equipment such as striping machines, athletic goals, and similar products ship via freight due to size and weight. If a customer requests to return freight-shipped items for any reason other than damage or USSC error, the customer is responsible for all return freight costs. In the event of damage in transit, USSC will file a claim with the carrier, arrange pickup, and reship the product at no additional cost to the customer.

Customer Service Policy

USSC is committed to excellent products and service.

  • On-Time Delivery: Orders processed within 24–48 hours.
  • Prompt Response: Inquiries within 1–2 business days.
  • Proactive Communication: Order status updates provided.
  • Respect: All customer contacts approached with service, respect, and cooperation.

Privacy Policy

USSC collects only data necessary to process and deliver orders (name, address, phone, email, payment details).

  • Data is not sold or shared outside USSC.
  • Protected with reasonable safeguards.
  • Customers may request access or deletion of data.
  • Cookies/technologies may be used to improve experience.

Shipping Policy

  • Operating days: Monday–Friday.
  • Orders ship in 24–48 hours.
  • Aerosols must ship ground.
  • Valid street address required.
  • Damages/loss reported immediately; concealed damages within 5 days (with photos).
  • Customer responsible for return shipping on incorrect/changed orders.
  • International shipping subject to additional fees/restrictions.

Force Majeure

USSC is not liable for delays due to causes beyond its control, including natural disasters, strikes, shortages, or transportation delays.

Governing Law

These terms are governed by Georgia law.

Arbitration / Dispute Resolution

Any dispute, claim, or controversy arising out of or relating to these Terms, any product purchased from USSC, or the relationship between the parties shall be resolved through binding arbitration conducted in Fulton County, Georgia, in accordance with the rules of the American Arbitration Association. Judgment on the award may be entered in any court having jurisdiction.

Indemnification

The Customer agrees to indemnify, defend, and hold harmless US Specialty Coatings, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, or expenses (including reasonable attorney’s fees) arising out of or in any way connected with the Customer’s misuse, alteration, or unauthorized application of products purchased from USSC.

Limitation of Damages

In no event shall US Specialty Coatings’ liability exceed the purchase price of the product giving rise to the claim. USSC shall not be liable for any indirect, incidental, special, or consequential damages of any kind, including but not limited to lost profits, regardless of the legal theory asserted.
